Terms of Service
Last updated: 27 Mayıs 2026
1. Parties and Scope
These Terms of Service are entered into between CyberendX Technology Inc. ("CyberendX") and any user or organisation registering for, or signing an enterprise agreement covering, the platform ("Customer"). Use of the platform constitutes full acceptance of these terms; if you do not accept them, please refrain from using the service.
2. Service Description
CyberendX is a cybersecurity orchestration platform comprising CyberendX EDR, Praxes SOAR, Xplore observability, Matrix threat intelligence and the Nexus AI gateway, delivered on an agentic AI backbone in an isolated tenant architecture. Service scope depends on your subscription plan and, where applicable, a signed Master Services Agreement (MSA).
3. Account and Access
Customer is responsible for the confidentiality of account credentials and for all activity occurring under its account. Suspected unauthorised access must be reported immediately to [email protected]. CyberendX strongly recommends enabling SSO/MFA and regularly rotating credentials.
4. Subscription, Payment and Renewal
Subscription fees are payable in advance, annually or monthly, based on the selected plan and user count. Payment terms for enterprise plans are governed by a separate agreement. Subscriptions automatically renew for the same term unless written notice of non-renewal is provided at least 30 days before the term-end date. Renewal fees may be calculated against the prevailing list price at the renewal date.
5. Acceptable Use
Customer agrees not to use the platform for any of the following purposes:
- Unlawful activity, malware distribution, or unauthorised penetration testing.
- Processing data that infringes third-party rights.
- Reverse-engineering the platform, extracting source code, or developing a competing service.
- Automated requests exceeding rate limits or any usage that may cause denial of service.
- Renting, sublicensing, or transferring account access to third parties for a fee.
In case of a violation, CyberendX reserves the right to suspend or terminate the service after reasonable prior notice.
6. Customer Data and Data Processing
All data Customer uploads to or processes through the platform ("Customer Data") remains Customer's property. CyberendX processes Customer Data solely to provide and improve the service. Where personal data is involved, a separate Data Processing Agreement (DPA) governs and the rules described in our Privacy Policy apply.
7. Intellectual Property
The platform, modules, source code, AI models, documentation, trademarks and design are the intellectual property of CyberendX. Customer is granted a non-exclusive, non-transferable, revocable right to use the platform for the duration of the subscription. Open-source components are governed by their respective licences.
8. Service Level (SLA) and Support
For enterprise subscriptions we commit to 99.9% uptime and 24/7 critical-incident support. Individual and standard plans are provided on a best-effort basis. SLA credits and full details are set forth in the applicable plan document or MSA addendum.
9. Warranties and Limitation of Liability
CyberendX provides the service with reasonable commercial care. To the maximum extent permitted by law, liability is limited to cases of wilful misconduct and gross negligence. Indirect damages, loss of profits, loss of data, or third-party claims are excluded. Aggregate liability is in any event capped at the fees paid by Customer in the 12 months preceding the event giving rise to the claim.
10. Termination
Either party may terminate the agreement in the event of a material breach not remedied within a reasonable cure period. Following termination, CyberendX shall provide a 30-day data-export window, after which Customer Data is securely deleted.
11. Governing Law and Jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of Istanbul Central (Çağlayan) shall have exclusive jurisdiction. Alternative dispute resolution (arbitration) may be agreed in writing at the request of enterprise customers.
